1. Introduction

These Terms of Service (“Terms”) govern your use of the Psst application (“Service”), operated by The Night Project. By installing or using the Service, you agree to these Terms.

2. Service Description

Psst is a Shopify application that allows store customers to send product hint emails to friends and family. The Service includes a storefront button, email delivery, and merchant analytics.

3. Account and Access

• You must have a valid Shopify store to use the Service
• You are responsible for maintaining the security of your Shopify account
• You must provide accurate information when configuring the app

4. Pricing and Billing

Psst offers a free tier and paid subscription plans. Paid plans are billed through Shopify’s billing system. Details of each plan, including hint limits and overage pricing, are displayed on the pricing page within the app.

• Subscription fees are billed monthly through your Shopify account
• Usage overages are charged per hint at the rate specified by your plan
• You may upgrade, downgrade, or cancel your plan at any time
• Refunds are handled in accordance with Shopify’s billing policies

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited communications, or bulk emails
• Transmit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any purpose other than its intended product hint functionality

We reserve the right to suspend or terminate accounts that violate these terms.

6. Email Delivery

Hint emails are sent via our email delivery partner, MailJunky.ai. While we strive for reliable delivery, we do not guarantee that every email will be successfully delivered. Delivery may be affected by recipient email providers, spam filters, and other factors beyond our control.

7. Intellectual Property

The Service, including its design, code, and branding, is the property of The Night Project. You retain ownership of your store content and data. By using the Service, you grant us a limited licence to use your product information solely for the purpose of sending hint emails.

8. Limitation of Liability

To the maximum extent permitted by law, The Night Project shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you have paid us in the preceding 12 months.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Termination

You may stop using the Service at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify merchants of significant changes via the app dashboard.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
